Second, it helps challenge improper investigation. If the investigation appears biased, mechanical, or without proper inquiry, it can be argued that the investigation is not in line with the intent of the law, thereby justifying bail.
Third, in cases involving consensual relationships between adolescents, courts sometimes recognize that such matters are wrongly brought under POCSO due to social pressure and lack of awareness.
Fourth, it supports the principle of weak prima facie case. If evidence appears weak due to improper handling, it strengthens the case for bail.
Important Practical Position
Bail in POCSO cases mainly depends on the presumption clauses under Sections 29 and 30, the gravity of the offence, age of the victim, and medical and documentary evidence.
Therefore, Section 43 is supportive in nature, not decisive.
